These Terms and Conditions (“Terms”) govern your access to and use of collectibleclassics.com and its related webpages, forms, communications, and online services operated by Collectible Classics (“Collectible Classics,” “we,” “us,” or “our”).

By accessing the website, submitting information, requesting or making an offer, contacting us, or otherwise using our services, you agree to these Terms. If you do not agree to these Terms, do not use the website or its services.

## 1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use our transaction-related services.

If you use the website on behalf of a company, trust, estate, or another person or entity, you represent that you have authority to act for and bind that party.

## 2. Our Services

Collectible Classics buys, sells, trades, and consigns collectible, classic, specialty, exotic, luxury, and other vehicles. Through the website, users may be able to:

- View vehicles offered for sale;

- Submit a vehicle for a potential purchase offer;

- Request information about a vehicle;

- Make an offer on a vehicle;

- Begin a vehicle-purchase transaction;

- Inquire about consignment or related services;

- Arrange payment, documentation, transportation, or pickup; and

- Communicate with our team.

The website provides general information and tools for beginning or supporting a transaction. A separate purchase agreement, bill of sale, consignment agreement, auction agreement, financing agreement, or other written document may apply to a particular transaction.

If these Terms conflict with a signed transaction document, the signed transaction document controls with respect to that transaction.

## 3. Vehicle Listings

We make reasonable efforts to provide accurate vehicle descriptions, photographs, videos, mileage, VINs, prices, availability, and other information. However, collectible and used vehicles may have age-related wear, repairs, modifications, replacement components, cosmetic imperfections, mechanical conditions, or incomplete histories.

Unless expressly confirmed in a signed transaction document:

- Website descriptions, photographs, videos, equipment lists, and other content are provided for general informational purposes;

- Mileage may be based on an odometer reading or information received from a prior owner or another source;

- Ownership history, accident history, restoration history, originality, matching-number status, service history, and similar details are not guaranteed;

- Colors and cosmetic details may appear differently because of lighting, photography, image processing, or display settings;

- Prices and availability may change without notice; and

- A listed vehicle may be sold, reserved, withdrawn, or otherwise become unavailable at any time.

Typographical, photographic, pricing, technical, or data errors may occur. Subject to applicable law and any signed agreement, Collectible Classics may correct an error and decline or cancel a transaction affected by that error.

Nothing on the website constitutes a guaranteed appraisal, certification, warranty, or representation concerning a vehicle’s condition, value, authenticity, safety, roadworthiness, or suitability for a particular use.

## 4. Purchasing a Vehicle

Submitting an inquiry, clicking “Buy Now,” making an offer, or taking another action through the website does not by itself reserve a vehicle or complete a sale.

A vehicle sale becomes binding only after:

1. Collectible Classics accepts the transaction;

2. All required transaction documents are completed;

3. Any required deposit or payment has cleared; and

4. All other stated transaction conditions have been satisfied.

Applicable sales or use taxes, title and registration charges, documentary fees, transportation expenses, inspection costs, financing charges, and other transaction-related amounts may be added to the advertised price when permitted by law. Applicable charges will be disclosed in the transaction documents.

Deposits, payment deadlines, cancellation rights, refunds, trade-ins, financing, delivery, title processing, and registration are governed by the documents issued for the individual transaction.

## 5. Vehicle Inspections and Condition

Prospective buyers should inspect—or hire a qualified independent professional to inspect—a vehicle before completing a purchase. Buyers are responsible for evaluating the vehicle’s mechanical, structural, cosmetic, and legal condition and determining whether it meets their needs.

Used and collectible vehicles may require inspection, maintenance, restoration, or repair. The availability of photographs, videos, records, descriptions, or staff assistance does not replace an independent inspection.

Unless a written warranty is expressly provided in the signed purchase documents or applicable law requires otherwise, vehicles may be sold **AS IS, WHERE IS, WITH ALL FAULTS**, without implied warranties from Collectible Classics.

No oral statement, advertisement, photograph, video, inspection summary, email, text message, or other communication creates a warranty unless the warranty is expressly included in a signed written agreement.

Any applicable warranty or legally required disclosure will be identified in the transaction documents, including any required Buyers Guide. Nothing in these Terms excludes or limits a warranty, remedy, disclosure requirement, or consumer right that cannot lawfully be excluded.

## 6. Selling a Vehicle to Collectible Classics

When you submit a vehicle for an offer, you represent that:

- The information you provide is accurate and complete;

- You are the vehicle’s lawful owner or are authorized to act for the owner;

- You have disclosed all known liens, ownership claims, title problems, significant damage, insurance losses, odometer discrepancies, mechanical problems, modifications, and other material facts;

- The VIN, mileage, photographs, records, and supporting documents are authentic and relate to the submitted vehicle; and

- You have the legal right to sell and transfer the vehicle.

An online, telephone, email, or preliminary offer is based on the information available when the offer is made. Unless Collectible Classics expressly states otherwise in a signed writing, an offer is not binding and may be revised or withdrawn after an inspection, title review, record verification, or discovery of inaccurate, incomplete, or omitted information.

Completion of a purchase may require:

- A satisfactory vehicle inspection;

- A clear and transferable title;

- Lien payoff information;

- Verification of the seller’s identity and authority;

- Signed transaction documents; and

- Delivery of the vehicle, keys, title, and agreed records or accessories.

Payment method, payment timing, title handling, lien payoff, pickup, and transportation arrangements will be confirmed as part of the individual transaction.

Website statements concerning the speed of an offer, payment, or pickup are estimates and not guarantees. Timing may depend on title verification, documentation, inspection results, banking schedules, carrier availability, the vehicle’s location, and other circumstances.

## 7. Consignment Services

Consignment services are governed by a separate written consignment agreement.

The consignment agreement will control matters including:

- Commission and fees;

- Vehicle possession and storage;

- Listing and advertising authority;

- Asking price and offer approval;

- Inspection, repair, detailing, and photography costs;

- Insurance responsibilities;

- Withdrawal from consignment;

- Transportation;

- Payment; and

- Completion of a sale.

If these Terms conflict with a signed consignment agreement, the consignment agreement controls.

## 8. Auctions and Third-Party Marketplaces

Collectible Classics may advertise or offer vehicles through third-party auction sites, marketplaces, listing services, vehicle-history providers, financing services, transportation providers, or other platforms.

Those services have their own terms, privacy policies, fees, bidding requirements, payment rules, and dispute procedures. Users are responsible for reviewing and following the applicable third-party terms.

Collectible Classics does not control and is not responsible for the availability, security, conduct, content, or policies of an independent third-party service.

A transaction completed through a third-party platform may be governed by the platform’s terms, these Terms, and separate transaction documents issued by Collectible Classics.

## 9. Transportation, Pickup, and Delivery

Transportation, pickup, and delivery dates are estimates unless a specific date is expressly guaranteed in a signed agreement. Delays may result from carrier availability, weather, road conditions, mechanical problems, payment clearance, title processing, government requirements, or other circumstances.

Independent transportation companies are separate service providers and are not employees of Collectible Classics.

Responsibility for transportation costs, insurance, risk of loss, vehicle inspection at delivery, and transportation-damage claims will be determined by the applicable transaction documents and carrier agreement.

Buyers should inspect the vehicle at pickup or delivery. Any claimed transportation damage should be photographed and recorded on the carrier’s condition report before the vehicle is accepted whenever reasonably possible.

## 10. Communications and Electronic Signatures

By providing your contact information, you consent to receive communications reasonably related to your inquiry or transaction by telephone, email, or text message.

If you consent to receive text messages:

- Message frequency may vary;

- Message and data rates may apply;

- You may reply **STOP** to opt out;

- You may reply **HELP** for assistance; and

- Consent to receive marketing text messages is not a condition of buying or selling a vehicle.

Opting out of text messages does not prevent Collectible Classics from communicating with you through another lawful method when necessary to respond to your request or complete an existing transaction.

You agree that electronic records and signatures may be used where permitted by law. You are responsible for keeping your contact information current and protecting access to your email accounts and electronic devices.

## 11. Acceptable Use

You may use the website only for lawful purposes. You may not:

- Submit false, misleading, fraudulent, or unauthorized information;

- Impersonate another person or misrepresent your authority;

- Interfere with the website’s operation or security;

- Introduce malware, harmful code, or disruptive automated requests;

- Attempt to gain unauthorized access to any system or information;

- Scrape, harvest, copy, or systematically extract website content without written permission;

- Use website content to create a competing database, inventory, or service;

- Violate another person’s intellectual-property, privacy, or legal rights; or

- Use the website in violation of any applicable law or regulation.

Collectible Classics may restrict or terminate access to the website when we reasonably believe a user has violated these Terms or created a security, legal, or operational risk.

## 12. User-Submitted Content

If you submit photographs, videos, vehicle descriptions, records, testimonials, reviews, or other content, you retain any ownership rights you hold in that content.

You grant Collectible Classics a non-exclusive, worldwide, royalty-free license to store, reproduce, format, modify, display, and share the content as reasonably necessary to:

- Evaluate a vehicle;

- Respond to your request;

- Market an authorized vehicle;

- Operate our services;

- Complete an authorized transaction; and

- Comply with legal or recordkeeping obligations.

You represent that you have the right to provide the content and that our permitted use will not violate another person’s rights.

## 13. Intellectual Property

The website and its text, photographs, videos, graphics, logos, design, software, and other content are owned by or licensed to Collectible Classics and are protected by applicable intellectual-property laws.

You may view and print limited portions of the website for your personal, non-commercial use. No other license is granted.

Without prior written permission, you may not reproduce, republish, distribute, modify, sell, license, or commercially exploit website content.

Vehicle names, manufacturer trademarks, third-party logos, and other third-party materials belong to their respective owners. Their appearance on the website does not necessarily indicate sponsorship, affiliation, or endorsement.

## 14. Third-Party Links

The website may contain links to auction platforms, marketplaces, transportation providers, mapping services, social networks, financing providers, vehicle-history services, and other third parties.

Collectible Classics does not control those services and is not responsible for their content, security, availability, terms, or privacy practices. Your use of a third-party service is subject to that service’s terms and is at your discretion.

## 15. Website Disclaimer

The website and its general online content are provided on an “as available” basis.

To the fullest extent permitted by law, Collectible Classics disclaims implied warranties concerning the operation of the website, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the website will always be available, uninterrupted, secure, current, complete, or error-free.

This website disclaimer does not replace or alter a signed vehicle transaction agreement or any legal right that cannot be waived.

## 16. Limitation of Liability

To the fullest extent permitted by law, Collectible Classics and its owners, officers, employees, contractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of—or inability to use—the website.

For a claim arising solely from use of the website, and not from a signed vehicle transaction, the aggregate liability of Collectible Classics will not exceed the greater of:

- The amount the claimant paid specifically to use the website during the preceding twelve months; or

- One hundred U.S. dollars ($100).

These limitations do not apply where prohibited by law or to liability that cannot lawfully be limited, including liability arising from fraud or willful misconduct.

Liability relating to a vehicle purchase, vehicle sale, trade, consignment, financing arrangement, or transportation service will be governed by the applicable transaction documents and applicable law.

## 17. Indemnification

To the extent permitted by law, you agree to indemnify and hold Collectible Classics and its owners, officers, employees, and agents harmless from third-party claims, losses, liabilities, and reasonable expenses arising from:

- Your unlawful or unauthorized use of the website;

- Information or content you submit;

- Your violation of these Terms; or

- Your infringement of another person’s rights.

This provision does not require you to indemnify a party for that party’s own unlawful conduct.

## 18. Governing Law and Venue

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law principles.

Unless applicable law requires otherwise, a legal proceeding relating solely to these Terms or use of the website must be brought in a state or federal court with jurisdiction over Berks County, Pennsylvania. Each party consents to the jurisdiction and venue of those courts.

A dispute provision contained in a signed transaction agreement will control disputes arising from that transaction.

## 19. Changes to These Terms

Collectible Classics may update these Terms periodically. Revised Terms will be posted on this page with an updated effective date.

Changes apply prospectively from the date they are posted. A change will not retroactively modify an existing signed transaction unless the parties agree in writing or applicable law permits the modification.

## 20. Severability and Waiver

If a provision of these Terms is found invalid or unenforceable, it will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in effect.

A failure to enforce a provision of these Terms does not waive the right to enforce that provision later.

## 21. Entire Agreement

These Terms, together with the Privacy Policy and any applicable signed transaction documents, constitute the agreement between you and Collectible Classics concerning the matters they cover.

Section headings are provided for convenience and do not affect interpretation.
